Salary History Inquiries Banned by More States and Localities

Salary history inquiry bans have been on the rise over the past year, with laws being enacted in several states and cities including Delaware, Oregon, Philadelphia, San Francisco, and New York City. These laws “generally prohibit employers from asking applicants about their prior salary during the hiring and salary negotiation process”. Additional states are reviewing similar legislation including Maryland and Texas, and other jurisdictions have passed legislation that “prohibits the government from inquiring about prior salaries, but does not restrict private employers”. Employers should carefully follow changes to local regulations.
