Retaliation Claim Proposed Guidance

The Equal Employment Opportunity Commission (EEOC) has released proposed retaliation claim guidelines to address the almost doubling of claims since guidance was last issued in 1998. Among the various components of the proposal offered by the EEOC are best practices, including the development and updating of anti-retaliation policies, employee training, and the review of the processes associated with retaliation complaints. If passed, the guidelines will not carry the full weight of the law, but employers are still advised to review the document in preparation of the potential changes.
