NYC Earned Sick Time Act

April 1st is fast approaching, leaving NYC employers with a little over a week to be sure they are in compliance with the Earned Sick Time Act. Effective April 1st, employers with 5 or more employees must provide 5 paid sick days to their employees, and employers with less than 5 employees must provide sick time, but it does not have to be paid. Due to the recent expansion of the Earned Sick Time Act, employers with 5 to 19 employees have until October 1st to comply as they are being provided a six month grace period from April 1st. In preparation, employers should make sure to review and revise existing sick time policies if necessary, review and update record keeping policies, provide notices to new hires going forward, and be aware of the Act’s ant-retaliation requirements.
