New York City: Fair Chance Act Final Regulations Made Effective August 5, 2017, Expansions Coming this October

Criminal Records Insurance Form Graphic ConceptFinal regulations of New York City’s Fair Chance Act, better known as the “ban the box” law, went into effect August 5th, expanding “previously issued ‘Enforcement Guidance'” and explaining employer requirements when “screening applicants and existing employees for promotions”. In addition, in an expansion of the act, as of October 31, 2017, “employers will no longer be able to inquire regarding an employee’s or applicant’s salary history” at any phase in the hiring process. Employers should review current hiring policies and forms to ensure compliance with these new regulations.
