Policy Regarding The First 90 Days

In the past it was commonplace to have a policy on how an employee would be operating under slightly different rules during the first 90 days of employment. Many of these policies stated that the employee could be terminated at anytime during the first 90 days, implying that from day 91 of employment forward they could not be terminated at anytime. In essence the company by virtue of this policy could be voiding their right to an “at-will” employment relationship. If you have one of these policies in place be sure to check the language and consider striking such a statement.
