Proposed Rules for NYC Fair Chance Act

Application For EmploymentThe New York City Commission on Human Rights released proposed rules to the NYC Fair Chance Act last month. The Act, otherwise known as “Ban the Box”, went into effect in October 2015, and prohibits NYC employers with four or more employees from asking about a candidate’s criminal record until after they are offered a position. The proposed rules provide definitions of terms, guidance for employers who inadvertently discover a criminal conviction history, the Fair Chance Act process, and clarification of exemptions under the Act.
