Employee Sues After Termination Following FMLA Request

Law BooksEmployers are cautioned to document all conversations relating to requests under the Family Medical Leave Act (FMLA). In a recent case, an employee was terminated for inappropriate behavior, but prior to his termination requested leave under the FMLA to care for his sick son. Though the former employer disputes the terminated employee’s claims, this suit could lead to a six figure settlement for the disgruntled former employee.
